US Businesses Sue Trump Over Trade War

A number of US businesspeople are suing President Donald Trump over his trade war policies against a number of countries through the recent implementation of high import tariffs at the US Court of International Trade.

The lawsuit was filed by the Liberty Justice Center, a legal advocacy group that represents a number of US businesses. They argued that the trade war has caused serious business losses.

The lawsuit was also filed because the business owners considered the policy illegal. They argued that the legality of the tariff setting was based on the International Emergency Economic Powers Act (IEEPA).

The IEEPA Act, they say, does give the president the authority to enact policies to respond to extraordinary threats to the US economy and security.

But the businessman said, those criteria have not been met in the policies taken by Trump.

The lawsuit also alleges that the law does not allow the president to impose tariffs unilaterally.

"No one should have the authority to impose a tax that has such profound global economic consequences," said Jeffrey Schwab, senior counsel at the Liberty Justice Center, in a statement quoted by CNN.com.

"The Constitution gives the authority to set tax rates—including tariffs—to Congress, not the President," he added.

Responding to the lawsuit, White House spokesman Harrison Fields said that the trade deficit with other countries is a national emergency.

"Trump supporters won't always oppose him, but President Trump stood up for Main Street by ending the exploitation of the United States by our trading partners—especially China," Fields said.

"The plan levels the playing field for businesses and workers to address our nation's national emergency of chronic trade deficits."

This is not the first lawsuit filed against Trump regarding his trade war policies.

On April 3, the New Civil Liberties Alliance (NCLA), a civil rights group, sued Trump, arguing that the IEEPA does not authorize the president to impose tariffs.

The lawsuit was filed in the U.S. District Court for the Northern District of Florida on behalf of Simplified, a Florida-based company.

"By using emergency powers to impose blanket tariffs on Chinese imports that are not authorized by law, President Trump has abused those powers, usurped Congress's right to control tariffs, and undermined the Constitution's separation of powers," said Andrew Morris, senior litigation counsel at NCLA, in a statement announcing Simplified's lawsuit.

Trump has been aggressively launching trade attacks on a number of countries recently, with Indonesia being one of the countries affected.

However, the Indonesian government decided not to counter Trump's attack. Indonesia instead chose to negotiate with the US government to prevent the attack from taking place.

One of the points of the negotiations is that Indonesia will purchase US$19 billion or around Rp318.9 trillion worth of products from the United States (US) (assuming an exchange rate of Rp16,784 per US dollar) to avoid US President Donald Trump's import tariff attacks.

Coordinating Minister for Economic Affairs Airlangga Hartarto said this was Indonesia's offer when meeting with US representatives on April 16-23 in Washington DC, USA.

"Indonesia's plan is to compensate for the delta in exports and imports, which amounts to US$18 billion to US$19 billion," Airlangga said at a press conference at the Coordinating Ministry for Economic Affairs office in Jakarta on Monday (April 14).
